Criminal Justice

Bail Reform

The Texas Democratic Party Supports amending Texas Constitution Art. 1 § 11, § 13 and Texas Code of Criminal 17.01 and 17.02 to create a pre-trial release system that:

·         presumes release on personal recognizance for people charged with non-violent offenses who have little or no criminal history;

·         requires immediate release of low-risk defendants under the least restrictive conditions necessary to guarantee appearance at court proceedings;

Re­entry

Texas Democrats support programs that decrease recidivism by providing ex-offenders with a pathway back to productive participation in society. Texas Democrats support reducing recidivism by:

·         increasing access to rehabilitation and re-entry programs, with a special emphasis on reducing drug use among people released from prison, including the reversal of policies that deny student loans and grants to those who have completed sentences for drug felonies; and

Mass Incarceration

·         ending the practice of sending poor people to jail or prison for inability to pay fines and court costs;

·         redirecting mentally ill offenders from the criminal justice system to treatment programs when the risk to public safety is low;

Eliminating Private Prisons

·         amending the Texas Constitution to require state and local governments to directly operate and perform all core services at prisons, jails, and detention facilities within the State of Texas, and expressly prohibit the use of private prisons, jails, and detention facilities within the State of Texas;

Democracy

·         existing voter protection policies under the federal Voting Rights Act and the Texas Voting Rights Act, and restoration of the federal preclearance policies in the Voting Rights Act that were overturned by the Supreme Court;

·         instituting vote by mail for all elections – federal, state and local;

·         the creation of a nonpartisan redistricting commission to end racial and political gerrymandering in our redistricting process;

·         a constitutional amendment to eliminate the electoral college and award the presidency to the winner of the nationwide popular vote, and failing that, we urge all states to join the National Popular Vote Interstate Compact, so that candidates must campaign everywhere and not just in swing states;

·         a return to paper ballots because they are more secure, much less expensive, and are the only method that can provide a truly auditable vote count;

·         the report and recommendations of the Unity Reform Commission to the Democratic National Committee as a carefully considered and eloquent prescription for strengthening democracy for all American citizens in general elections and Democratic Party nominations.

Ethics in Government

·         requiring elected officials throughout the state, including local or county officials, to file a personal financial statement to allow for more transparency; and

·         requiring every candidate for the President of the United States to disclose their complete federal tax return and, upon election, place private holdings in a blind trust for divestment.

Good Jobs Build Strong Communities

·         Every American should have a right to a job; therefore, federally funded jobs paying at least a living wage with health insurance and other typical benefits on projects selected by the states and local governments must be available in or near every community.

Healthcare for All

The Texas Democratic Party asserts that healthcare is a human right, not a privilege for the few. Texas Democrats recognize that the health and well-being of Texas residents cannot be based on decisions made by non-healthcare professionals whose primary concern is the financial well-being of a corporation rather than the well-being of an individual.

·         support the inclusion of a “Single Payer Option” as an addition to the plans currently offered under the state exchange systems;

Cannabis Reform

·         Texas legislation to legalize possession and use of cannabis and its derivatives and to regulate its use, production and sale as is successfully done in Colorado, Washington and other States;

Gun Violence Prevention

·         Closing loopholes that allow guns to be sold or traded without passing a mandatory and thorough background check;

·         Enacting legislation to require all individuals charged with domestic violence, human trafficking, sexual assault, domestic or foreign terrorism, stalking or any violent felony to temporarily surrender all weapons and ammunition in their possession to law enforcement pending adjudication of their case(s);

·         Enacting sensible gun laws to curtail the availability of weapons with extended ammunition magazines, including rapid-fire, magazine-fed, military-style assault weapons;

Energy and Environment

A Moratorium on Fracking

·         a moratorium on new fracking wells;

·         set a goal of shutting down existing fracking wells by 2026;

·         set a goal of ending the practice of injecting wastewater by 2023;

Clean and Available Water

• Access to clean drinking water is a human right.

Immigration

·         strongly oppose the Trump Administration’s policy abusing children by of separating children from their parents at the southern border and denounce housing children in tent cities;

·         strongly oppose “tender age” shelters for infants and small children;

·         strongly oppose the Trump Administration so called “zero tolerance” approach to immigration;

·         strongly oppose the Trump Administration’s policy to no longer recognize asylum claims or Temporary Protected Status for refugees fleeing forced gang recruitment and violence perpetrated by gangs and refugees fleeing domestic violence;

·         support securing and protecting our border, while treating asylum seekers humanely;

·         strongly oppose any type of bans based on religious affiliation or country of origin;

·         strongly oppose efforts to build a border wall of any size and the unrealistic claim, and possibly abandoned claim, that a foreign country will pay for a border wall;

EPA Ruling Means More Jobs for Texans

In this week’s version of Sen. Cornyn’s weekly email to constituents he makes some spurious claims about Pres. Obama’s new EPA regulations and energy costs; especially how they will affect Texans. If anything the new regulations will hasten the switch from coal to natural gas for electricity generation which will improve the Texas job outlook.

For most of this year natural gas prices have been falling and drilling activity in the Eagle Ford shale and the Barnett shale areas have dropped precipitously. The new EPA regulations on power plant emissions will encourage electric power companies to switch to natural gas thereby increasing demand for it and hence promoting drilling in Texas again. Drilling brings jobs and good paying ones at that.

An additional benefit is that wind and solar generation will also be encouraged and they produce more high paying jobs than coal does and Texas is a prime location for both. So why is Sen. Cornyn knocking the EPA regulations? Could it be that the investors who own those old dirty coal plants that will be shuttered stand to lose out on further profits? Could it be his campaign contributors from the coal industry aren’t happy?

"Mom's" letter to the President on job creation

Dear Mr. President,

Having lived through the “Great Depression”, I’ll be 82 later this month, I can speak from experience that many of your esteemed advisers cannot. I am a child of an unemployed laborer who died prematurely of a heart attack and a disabled homemaker. I went to school often having eaten no breakfast and bringing nothing for lunch. I must tell you that while the current “Great Recession” is certainly not as bad as when I was growing up that is cold comfort for workers and their families who through no fault of their own have been without jobs for several years.

Franklin Delano Roosevelt has been my hero since I was old enough to say his name and I know from terrible experience that his policies are what saved my life and that of my sister and three brothers. The Herbert Hoover clones in Congress would have America cut spending and therefore cut more jobs, how can that possibly be the remedy for the lack of jobs we already suffer? Even Richard Nixon knew such actions were foolhardy for he said “We’re all Keynesians now.”

FDR recognized that the American people he loved were suffering under Hoover’s policies. I know that you too feel for the millions of Americans who are suffering today. I urge you to put aside the attempts at bi-partisanship which the party of Hoover apparently sees as weakness and proudly follow Roosevelt’s lead by putting Americans back to work building for our future.

Jobs, taxes and bringing the troops home will fix the budget deficit

Betty Clifford’s tirade is simply too much to ignore. Any economist whether left, right or center will tell you that governments aren’t like families when it comes to budgets. We were paying down our debts before President Bush and his cronies decided that the ultra-wealthy deserved even bigger tax breaks than they already had. So yes, one of the steps to reducing our budget deficit will have to be letting the Bush tax cuts expire. Another step will be to end the occupation of Iraq, end the war in Afghanistan and bring all our troops home.

Most importantly because it is both a major cause of our deficit and the damage it is doing to families all over this nation we must focus on creating jobs. Now I’m not talking about more tax cuts to “stimulate” big companies because there’s plenty of evidence that doesn’t work, just look at the Bush years where we had big tax cuts and no change in unemployment. No, I’m talking about investing in the infrastructure that we’ve allowed to crumble all over this nation like the interstate highway bridge in Minneapolis that collapsed killing 13 people August 1, 2007.

If we put people back to work they’ll spend their paychecks which will increase demand at stores all over the country and they’ll hire more staff and all of them will pay more taxes. Then we’ll also have the benefits of resurfaced highways and replacement bridges to deliver the goods that make the economy run.

The election was all about jobs, jobs, jobs so why did we elect Republicans?

In the last election the American people indicated they wanted a focus on jobs and the economy. They were so unhappy about the state of the economy and shortage of jobs that they threw out the Democratic majority in the US House and gave the Republican Party a super-majority of 101 seats in the state House. With jobs and the economy as an overwhelming mandate what did we get?

A congressional push for a five-year, $100 million plan to pour taxpayer money into a religious school voucher scheme in Washington, D.C.

A vote reaffirming the importance of "In God We Trust" as the national motto, and a call for its display in all public schools and other public buildings.

A vote to end federal support for family planning.

A federal budget bill that would end Medicare.

A state budget bill that damages public education by reducing funding 10 to 12 %. We’re already 49^th in per student spending on education.

Sharia Law bills that attempt to protect us from something that we’re already protected from by the United States Constitution’s First Amendment.

A bill to force invasive, medically unnecessary sonograms on women who wish to legally terminate their pregnancies.

I could go on but by now I’m sure you’ve noticed that there are no proposals to actually generate jobs either directly or indirectly, in fact by cutting the state education budget Texas will lose tens of thousands of jobs. So exactly why was it that Republicans were elected?

The insanity of tax breaks for millionaires

I keep hearing the TEA Party screaming that the reason they want Democrats out of office is because they’re all about big government and spending the taxpayer’s money. What they don’t seem to get is that last month our government shed nearly 160,000 jobs. The government now employs fewer people than it did during the Bush administration.

Republicans claim that lower taxes would foster more economic growth and more jobs but if you look at the last six years of the Bush presidency when taxes were near a century low you’ll find that zero net new private sector jobs were created. The remedy for this they claim is even lower taxes. Doesn’t this remind you of the famous remark “Insanity is doing the same thing over and over again and expecting different results”?

After WWII, the event which compelled massive deficit spending that finally brought this country out of the Great Depression, the U.S. was much deeper in debt than we are today. Through wise management by Harry Truman and Dwight Eisenhower who invested in education via the G.I. Bill and infrastructure like the interstate highway system our country became prosperous once again and the standard of living for rich and poor alike improved immensely.

The Republican argument that cutting government spending will help create jobs is kind of like a doctor telling you that the solution to your anorexia is to go on a diet.

Letter to Congressman Cuellar in light of the Massachusetts special election

Dear Congressman Cuellar,

Immediately after the Massachusetts Senate special election a Research 2000 poll of Brown voters in shows 82% of Obama voters who went for Brown support the public option and by a 3:2 margin think that the current bill doesn't go far enough. The Obama voters who stayed home think the bill doesn't go far enough by a 6:1 margin.

The Democratic Party has less than 10 months to start governing as a people-powered party, or we will lose both the House and the Senate. With the election of Scott Brown to fill Sen. Kennedy’s unexpired term the damage is done. Unless the Democrats move aggressively to correct the perception that we are the party of backroom deals and massive corporate bailouts, 2010 will be more of the same. Given that the Cook Political Report rates TX 28 as even between the Democrats and Republican you’re on the bubble and are likely to be one of the losers if the party fails to pass populist legislation.

So if you want to activate base voters you need to get behind a big jobs bill to put the nearly 10% of Texans who are unemployed back to work. You need to pass a strong health care reform bill with the Public Option. Surveys show that likely 2010 voters "oppose a mandate to purchase private insurance by 64% to 34% but support a mandate with a choice of private or public insurance by 60% to 37%."

You and the party need to pass green energy legislation and come to grips with the fact that global climate change will happen within the lifetime of many of today’s voters if you don’t do something now. Finally it’s time to stop pouring blood and treasure into Iraq and Afghanistan and bring our troops home so we can spend the money here on infrastructure, health care and education. Those are winning issues in the upcoming election.

I like a quote I read recently, "… a Democratic Party that would abandon their central initiative this quickly isn't a Democratic Party that deserves to hold power." I would add that if the party doesn't stick to the principles it professes to hold and stand up to the lobbyists you’ve kowtowed to from the start, "holding power" won't be anything you have to worry about because the Tea Party is gunning for you. In order to be re-elected you’re going to need the party base proud of what you’ve done and actively campaigning for you and not sitting on their hands at home like the folks in Massachusetts.
